When buying real estate, a competent Toronto Real Estate Lawyer is a must.

The most important documents involved in a purchase is the Agreement of Purchase and Sale and the mortgage financing documents (link here).


Both documents are legally binding

Despite the fact that a purchase can be the most important financial decision we make in out lives, few have a lawyer involved in the Agreement of Purchase of Sale or the mortgage financing documents.

This is probably because of the expense involved in making offers on multiple properties and the back and forth negotiations involved between seller and buyer and the time sensitive nature of these negotiations.

However, you can have a real estate lawyer review your offer or mortgage financing documents before they become final by having your agent insert a condition that the offer is conditional upon legal approval. Many agents will advise otherwise but if possible within the parameters of the deal.

Be certain that your agent is ethical and has the experience to advise you properly. There may be times when you need to just do the deal, but you should be fully advised of the pros and cons of forgoing the advice of a real estate lawyer at this stage of the deal.

Make certain your lawyer is skilled enough to insert and explain all the clauses in the contract you are signing.
